Terms of Service

You must be at least 18 years old (or the age of majority in your country) to create an account and purchase subscriptions or credits.

Children may use mimitalks only through an account created and supervised by their parent or legal guardian. The account owner is responsible for all activity on the account.

mimitalks lets children talk to fictional characters (such as Santa Claus, the Easter Bunny, and the Tooth Fairy) through conversations, audio messages, and videos generated by artificial intelligence.

• Characters are fictional and their responses are generated by AI: they are not real people.
• AI-generated content may occasionally contain errors or imprecisions. It is entertainment and educational content, not professional advice (medical, psychological, legal, or otherwise).
• We apply content filters designed to keep conversations age-appropriate, and we continuously improve them.

mimitalks offers the following paid options (prices in US dollars; local prices may vary by store and currency):

• Basic, US$ 1.49/month: all characters, 10 personalized 10-second audio credits per month, 2 personalized 10-second video credits, and access to special features.
• Premium, US$ 2.99/month: all characters, 1 custom character (coming soon), 20 personalized 10-second audio credits per month, and 4 personalized 10-second video credits.
• Extra credits (one-time purchases): video credit at US$ 0.99 (1 personalized 10-second video); audio credit at US$ 0.29 (1 personalized 10-second audio).

All payments are processed by the Apple App Store or Google Play. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal, through your store account settings.

Unless otherwise stated in the app, unused monthly credits do not roll over to the next billing cycle. Extra credits purchased separately do not expire while your account is active.

Refunds are handled according to the policies of the Apple App Store and Google Play. Prices may change; if they do, we will give you advance notice and the change will only apply to the next billing cycle.

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms.
• Attempt to bypass safety filters, moderation, or technical limitations.
• Reverse-engineer, scrape, or extract data from the service.
• Use the service to harass, harm, or deceive others.
• Share your account or resell access to the service.

The mimitalks app, brand, design, and characters are protected by intellectual property laws. Folk figures such as Santa Claus are part of the public domain; our specific character designs, names, and voices are our own creations.

Personalized audio and video generated for you may be used for personal, family, non-commercial purposes. You may not sell or commercially distribute content generated by the service.

The service is provided "as is". To the maximum extent permitted by law, we disclaim warranties of uninterrupted or error-free operation, and our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the event. Nothing in these Terms limits rights that consumer protection laws grant you and that cannot be waived.

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that put the safety of users, especially children, at risk. If we terminate your account without cause, we will refund the proportional unused value of active subscriptions where required by law.

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by e-mail before they take effect. Continuing to use the service after the changes means you accept the new Terms.

These Terms are governed by the laws of Brazil, without prejudice to mandatory consumer protections of the country where you live. Disputes will be resolved in the courts of your domicile when consumer law so provides.
